Basic salary in the UAE: allowances, gratuity and the split

What counts as basic salary and what as allowances, why gratuity, overtime and leave salary use basic, the DIFC and ADGM floors, and asking for a higher basic.

Short answer

Basic salary is the wage in your contract without any allowance or benefit in kind. It matters more than its size suggests: end-of-service gratuity, overtime and the pay for untaken leave are all worked out on basic alone. Onshore the law sets no minimum share, and the market norm is a basic of 50% of the package or more; in the DIFC, end-of-service pay uses at least 50% of your wage whatever the basic.

Basic salary and allowances in the law

The labour law defines the basic wage as the wage in the contract “which does not include any other allowances or benefits in-kind”, and the wage as the basic wage plus the cash allowances and benefits in kind the contract gives you (Decree-Law 33 of 2021, Art. 1 (opens in a new window)). A Dubai offer usually splits the monthly pay into:

  • Basic salary: the part the law's calculations use.
  • Housing: the employer provides a home, pays a housing allowance or includes it in the wage (Art. 13(4)).
  • Transport and other allowances: whatever the contract names, such as phone or education.

The offer should state each part and the monthly total. One “all-inclusive” figure hides the basic: see pay in our offer letter guide.

Why the split matters: gratuity, overtime and leave salary

Three things you're owed are worked out on basic salary only (the labour law (opens in a new window)):

  • End-of-service gratuity: 21 days of basic pay for each of your first 5 years, then 30 days a year (Art. 51).
  • Overtime: basic pay plus at least 25% for each extra hour (Art. 19(2)).
  • Leave salary: annual leave you haven't taken when you leave is paid on basic (Cabinet Resolution 1 of 2022, Art. 19(2)). See how leave salary is calculated.

So two offers with the same monthly total can be worth different amounts. Gulf News puts it plainly: the basic decides your end-of-service benefits (Gulf News (opens in a new window)), and people comparing offers on r/dubai (opens in a new window) call a low basic a way to cut gratuity.

What a lower basic costs you

Take a typical software engineer package of AED 30,500 (≈ ₹7.9 lakh) a month. With basic at the usual 60%, or AED 18,500 (≈ ₹4.8 lakh), your gratuity after 5 years is about AED 64,750 (≈ ₹16.8 lakh). Make the basic 50%, or AED 15,500 (≈ ₹4.0 lakh), and the same package pays about AED 54,250 (≈ ₹14.1 lakh): AED 10,500 (≈ ₹2.7 lakh) less, with no change to your monthly pay.

The DIFC and ADGM set a floor

In the DIFC, the basic used for end-of-service pay can't be less than 50% of your wage, whatever your contract says, and the employer pays into DEWS instead of a gratuity: at least 5.83% of your basic a month for the first 5 years and 8.33% after.

In ADGM in Abu Dhabi, basic pay must be at least 50% of your wages. (ADGM (opens in a new window), Khaleej Times on the DIFC rule (opens in a new window))

Asking for a higher basic

If the basic is below 50% of the fixed pay, ask to move part of an allowance into it: the monthly cost to the employer is the same today, so it is often an easier ask than a raise. For the rest of the package, see how to negotiate a job offer in Dubai.

“Could the basic be at least 50% of the monthly package?”

The offer review flags a low basic and checks the rest of the letter too: the rule on basic salary.

Questions

What is basic salary in the UAE?

The wage in your contract without any allowance or benefit in kind, as the labour law defines it. Housing, transport and other allowances come on top; together they make your wage.

What percentage of salary is basic in the UAE?

The labour law sets no percentage onshore. The market norm is 50% of the fixed monthly pay or more. In the DIFC, end-of-service pay uses at least 50% of the wage whatever the stated basic, and in ADGM basic must be at least 50% of wages.

Is gratuity calculated on basic salary or full salary?

On basic salary only: 21 days of basic pay for each of the first 5 years, then 30 days a year. Allowances don't count.

Is overtime paid on basic salary in the UAE?

Yes: overtime is basic pay plus at least 25% for each extra hour, unless the role is genuinely supervisory.

Is housing allowance part of basic salary?

No. The basic wage excludes allowances. Housing is either provided, paid as an allowance or included in the wage, and the contract should say which.
